Changes regarding A1 German requirement for spouses for family reunion

Current changes regarding the A1 German requirement for spouses in family reunification

Spouses who want to join their partner in Germany, i.e. applicants for a family reunification visa, are affected by the changes that have been in effect since December 31, 2022. There is still a lot of confusion here, so we summarize here what currently applies.

Basically, the following regulations are in force and and are also not new: Depending on the residence title or visa of the partner who wants to work in Germany or is already working in Germany, simple German language skills based on a recognized A1 language certificate may be mandatory for the spouse. Simple knowledge of German is proven by an A1 certificate according to the Common European Framework of Reference.

The amendment to §§ 30, 32 AufenthG regarding the requirement of German language skills in the case of family reunification to skilled workers came into force on 31.12.2022.

In these cases, an A1 language certificate is now no longer required

If your spouse is working in Germany under one of the following paragraphs (details can be found on the residence permit or visa), as a spouse applying for a family reunification visa, you are no longer required to present an A1 language certificate under the latest amendment:

  • Blue Card EU, § 18b II AufenthG
  • ICT-Card, § 19 AufenthG in connection with §10a BeschV
  • Highly qualified workers, § 18b I AufenthG
  • Skilled workers with vocational training, § 18a AufenthG
  • Scientists and academics, § 18d AufenthG
  • Intra company transfer, § 19c I AufenthG in conjunction with § 10 BeschV
  • IT specialists, § 19c II AufenthG in conjunction with § 3 BeschV
  • Self-employed persons, § 21 AufenthG
  • Employees in special functions, § 19c I AufenthG i.V.m. § 3 BeschV
  • Settlement permit for skilled workers, § 18c AufenthG

Individual case examination remains in place

There may be further exceptions in individual constellations. These will be examined by the visa officer of the embassy on a case-by-case basis.

Please note: If your spouse holds a visa or residence permit other than those mentioned above, you must present an A1 language certificate when joining your spouse.

This information does not apply to Schengen visa applications, i.e. 3-montas visas, e.g. for tourist purposes.
